Tabs do not align left unless Menu bar is visible

If the Menu bar is hidden, the tab bar is indented 40 pixels. If Menu bar is visible, the Tab bar aligns all the way to the left.

I tried to report this to bugzilla, but I cannot get logged in, it refuses to accept my credentials even after sync and entering a 6 digit code.
